Xuhui District People's Court yesterday ordered Kexun Express Delivery Co Ltd to compensate for a client's loss since one of its employees escaped with the customer's money. A digital technology company which the court would not name, had been a long-time Kexun client. All of Kexun's services to the company were handled by an agent named Yuan Deli. On September 14, an employee of the digital company surnamed Qiang entrusted Yuan to deliver 24,500 yuan (US$2,952) in cash to another company. A delivery document was then filled out. However, two days later the money still hadn't been delivered. Qiang later learned that Yuan never showed and had taken the money. He then had to pay another 24,500 yuan to his client and filed a lawsuit asking Kexun for compensation. Kexun argued that it was banned from delivering cash. Yuan has not been seen since leaving the company on September 14. Legally, the cash was a consignment to Yuan instead of the company. The company should ask for compensation from Yuan. The plaintiff called the argument unreasonable. The court ruled the two sides formed a contract since Yuan had long represented Kexun. Kexun should offer safe and effective service to the plaintiff. |
